I. Drafting Background
To effectively mitigate and address the risk of cross-border transmission of infectious diseases, establish a monitoring system, and implement the requirements of Article 25 of the newly revised Frontier Health and Quarantine Law of the People's Republic of China (implemented on January 1, 2025) regarding "the GACC together with the disease prevention and control department of the State Council to establish a monitoring system for cross-border transmission of infectious diseases", the GACC, in accordance with the Frontier Health and Quarantine Law of the People's Republic of China and other laws, and the provisions of administrative regulations, in conjunction with the National Health Commission and the National Disease Control and Prevention Administration, the "Implementation Measures for Surveillance of Infectious Diseases at Frontier Ports" (hereinafter referred to as the "Implementation Measures") were formulated. The release of the Implementation Measures is conducive to standardizing the monitoring of infectious diseases at frontier ports, further improving the monitoring and early warning system, thus effectively ensuring national biosecurity.
II. Main Contents
The Implementation Measures consist of 5 chapters with a total of 23 articles.
(I) General Provisions
5 in total. This section outlines its foundation of Implementation Measures, defines what constitutes infectious disease surveillance at frontier ports, specifies the range of infectious diseases covered by these measures, delineates the duties of customs and health agencies, and details the scope of disease monitoring at these frontier ports.
(II) Surveillance and Management
4 in total. This section clarifies the roles and responsibilities of customs and health departments in developing plans and implementing strategies for disease surveillance at frontier ports. It also covers organizing and supervising these activities, and includes provisions for monitoring overseas disease outbreaks, conducting risk assessments, and delivering risk advisory information. It also underscores the importance of enhancing the management of data and information related to infectious disease surveillance at frontier ports.
(III) Monitoring Measures
5 in total. This section specifies the surveillance measures required for travelers entering or exiting the country who might be at risk of spreading respiratory, digestive, vector-borne, or contact-transmissible infectious diseases as stipulated in Article 3 of the Implementation Measures that may spread across borders. Additionally, it is specified that when customs identify new infectious diseases or sudden unexplained outbreaks at ports that necessitate health and quarantine measures, they should follow Articles X, XI, XII, and XIII of the Implementation Measures to take appropriate actions.
(IV) Information Reporting and Communication
4 in total. This section clarifies the relevant requirements for notification by customs, health departments and infectious disease information departments of disease prevention and control departments, as well as the public's obligations for reporting infectious disease information.
V. Guarantee Measures
5 in total. This section clarifies that all involved units and departments shall enhance organizational leadership, leverage technological advancements, enhance talent development, establish robust health and quarantine technical facilities, and ensuring adequate funding. Furthermore, it is specifies that with the enforcement of the Implementation Measures, the previous Trial Measures for Surveillance of Infectious Diseases at Frontier Ports (promulgated by the Ministry of Health on June 18, 1980) will be repealed.
