Inspection and Quarantine Requirements for Imported Bulgarian Distiller's Dried Grains with Solubles

I. Basis for Inspection and Quarantine

(I) The Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine and its Implementation Regulations, the Food Safety Law of the People's Republic of China and its Implementation Regulations, and the Law of the People's Republic of China on Import and Export Commodity Inspection and its Implementation Regulations;

(II) Regulation on Administration of Safety of Agricultural Genetically Modified Organisms;

(III) Supervision and Management Measures for the Inspection and Quarantine of Import and Export Feed and Feed Additives;

(IV) Protocol of Sanitary and Phytosanitary Requirements for Bulgarian Distiller's Dried Grains with Solubles (DDGS) to be Exported to China Between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Food and Forestry of the Republic of Bulgaria.

II. Name of Commodities Permitted for Entry

Distiller’s dried grains with solubles (DDGS) refers collectively to the industrial by-products, namely distillers dried grains (DDG) and distillers dried solubles (DDS), generated during the production of ethanol from corn through a fermentation process facilitated by yeast, enzymes, and other agents.

III. Registration of Enterprises

Enterprises engaged in the production and processing of DDGS intended for export to China must be evaluated and authorized by the Bulgarian Food Safety Agency (hereafter "BFSA"), as designated by the Ministry of Agriculture, Food, and Forestry (hereafter "MAFF"). The BFSA will then recommend these companies to the General Administration of Customs of the People’s Republic of China (hereafter "GACC"), where they must undergo onsite inspections or document review by GACC before obtaining registration approval. The catalog of enterprises approved for registration is accessible on the GACC website and undergoes updates quarterly.

IV. Quarantine Pests

Exported DDGS to China must be free from the following Chinese quarantine pest concerns:

1.Cernuella virgata Da Costa

2. Callosobruchus maculatus (F.)

3. Trogoderma granarium Everts

4. Ptinus tectus Boieldieu

5. Solenopsis invicta Buren

6. Sorghum almum Parodi.

7. Sorghum halepense (L.) Pers.

8. Verticillium dahliae Kleb

V. Product Production and Export Requirements

(I) Packaging, Storage, and Transport.

1. DDGS exported from Bulgaria to China may be transported in bulk or packaged form; measures must be taken to prevent any leakage during transportation. The tools used for transportation should be thoroughly cleaned and disinfected as necessary. If bags are used for transportation, they must be brand new, clean, hygienic, and free of any toxic or harmful substances.

2. Each container or ship's hold (in the case of bulk shipping) transporting DDGS must include at least one package mark. This mark should indicate the name and registration number of the production/processing enterprise and feature the text "Bulgarian Dried Grains with Solubles (DDGS) Exported to the People's Republic of China" in both Chinese and English. Cargo packaging must include Chinese labels adhering to the standards outlined in China's "Feed Label"(GB 10648).

(II) Quarantine and Certification Requirements before Departure.

1. BFSA shall implement inspection and quarantine measures on DDGS prior to export to China, ensuring compliance with Chinese feed safety and hygiene standards, and preventing the introduction of quarantine pests of concern to China listed in Article IV of these Requirements, as well as other quarantine pests, plant seeds, animal feces, animal carcasses, poultry feathers, plant or animal residues, soil, and genetically modified ingredients not approved for import by Chinese authorities.

2. Each batch of DDGS exported to China must be accompanied by a veterinary health certificate issued by BFSA and a phytosanitary certificate that conforms to the specifications of the International Standard for Phytosanitary Measures No. 12. The phytosanitary certificate must specify the name and registration number of the production/processing enterprise, container identification numbers, and other pertinent information. If pest control treatments are applied to the DDGS prior to export or during transportation, the certificate must detail the treatment methods and corresponding parameters.

3. The phytosanitary certificate's additional declaration should state:"This consignment is in compliance with Protocol of Sanitary and Phytosanitary Requirements for Bulgarian Distiller's Dried Grains with Solubles (DDGS) to be Exported to China Between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Food and Forestry of the Republic of Bulgaria."

VI. Entry Inspection and Quarantine

(I) Certificate Verification.

Verify whether the phytosanitary certificate and veterinary health certificate are authentic and valid.

(II) Goods Inspection.

Conduct inspection and quarantine on imported DDGS in accordance with the relevant laws, administrative regulations, and rules, considering Articles IV and V of these Requirements. Authorized entry will be granted to imported items that have passed inspection and quarantine.

VII. Handling of Noncompliance

If non-compliance is identified with imported Bulgarian DDGS, the following measures shall be implemented:

(I) If no valid phytosanitary certificate or veterinary health certificate is provided, the consignment will be be returned or destroyed;

(II) If live quarantine pests or other live harmful pests are identified, the consignment will undergo treatments or be returned or destroyed;

(III) If soil or genetically modified components unapproved by the People's Republic of China are detected, the consignment will be returned or destroyed;

(IV) If animal excrement, animal carcasses, poultry feathers, plant seeds are present, or if they do not comply with Chinese regulations concerning feed safety and sanitation standards, the consignment will undergo appropriate treatment or be returned or destroyed as per related laws;

(V) If a product is found to not comply with China's stipulated feed safety, hygiene, and health standards, it will be returned or destroyed accordingly.

If the aforementioned violations are detected, the GACC will formally notify the MAFF and may take measures aligned with the severity, including suspending associated production entities or halting the import of Bulgarian DDGS into China.
